Terms of Service

1. Acceptance of Terms

By accessing or using AI Music Hub ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Stripe Services Agreement

Payment processing services for artists on AI Music Hub are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”).

By agreeing to these terms or continuing to operate as an artist on AI Music Hub, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of AI Music Hub enabling payment processing services through Stripe, you agree to provide AI Music Hub accurate and complete information about you and your business, and you authorize AI Music Hub to share it and transaction information related to your use of the payment processing services provided by Stripe.

3. Prohibited Monetization Categories

The monetization of content in the following categories is STRICTLY PROHIBITED:

  • Adult content and services: Content that contains nudity or explicit sexual acts (e.g. subscriber-only nude images, adult audio/video live chat).
  • Intellectual property or proprietary rights infringement: Copyright-infringing content (e.g. leaked music albums).
  • Violent extremism: Content that engages in, encourages, promotes or celebrates unlawful violence toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.

4. Prohibited Content & Copyright Standards

To comply with Stripe's Terms of Service and international copyright laws, the following content is STRICTLY PROHIBITED. Violations will result in an immediate permanent ban.

ZERO TOLERANCE POLICY:

  • NO Covers: AI-generated versions of existing copyrighted songs are banned.
  • NO Remixes: Unauthorized remixes or "bootlegs" of protected tracks.
  • NO Soundalikes ("Same Tone"): Content generated to deliberately mimic the voice, style, or identity of specific real-world artists (e.g., "AI Drake", "AI Taylor Swift") is strictly forbidden as it violates publicity rights and Stripe's IP policies.
  • NO Unauthorized Samples: Using copyrighted stems or recordings without license.

By uploading, you certify that your work is original. We use automated scanning to detect infringement.

5. Licensing and Rights

When you upload music to AI Music Hub:

  • You retain ownership of your content
  • You grant AI Music Hub a non-exclusive license to display, distribute, and promote your content on the platform
  • Buyers receive the license type they purchase (Digital Download, Cover License, Standard License, Extended License, or Copyright Purchase)
  • Each license type has specific usage rights as described on the song detail page
  • You are responsible for honoring the licenses you sell

6. Payments, Fees & Tipping

Payments: AI Music Hub uses Stripe Connect for payment processing. Artists must connect a Stripe account. We retain a 15% platform fee plus Stripe's processing fees (~2.9% + $0.30).

Tipping & Gratuity Policy

To comply with financial regulations and Stripe's requirements for accepting tips:

  • Service-Based: Tips are voluntary gratuities for the service of content creation. They are NOT peer-to-peer money transfers.
  • Not a Donation: Tips are not tax-deductible charitable donations. Artists are not non-profit organizations.
  • No Exchange Required: Tipping is optional and not required to access content.
  • Non-Refundable: All tips are final.

7. Prohibited Activities

Users may not:

  • Upload content that infringes on intellectual property rights
  • Misrepresent the origin or ownership of content
  • Upload human-performed music claiming it as AI-generated
  • Engage in fraudulent transactions or payment manipulation
  • Use the platform for money laundering or illegal activities
  • Harass, threaten, or harm other users
  • Attempt to circumvent platform fees or payment systems
  • Create multiple accounts to manipulate rankings or contests

8. RESTRICTED REGIONS - IMPORTANT

In compliance with U.S. Treasury Office of Foreign Assets Control (OFAC) sanctions and international regulations, AI Music Hub DOES NOT provide services to individuals or entities located in the following countries and regions:

  • 🚫 Cuba
  • 🚫 Iran
  • 🚫 North Korea (DPRK)
  • 🚫 Syria
  • 🚫 Russia
  • 🚫 Belarus
  • 🚫 Crimea Region (Ukraine)
  • 🚫 Donetsk People's Republic (Ukraine)
  • 🚫 Luhansk People's Republic (Ukraine)

Any attempt to access our services from these regions, use VPNs to circumvent these restrictions, or conduct transactions on behalf of individuals in these regions is strictly prohibited and may result in immediate account termination, forfeiture of funds, and reporting to relevant authorities.

This list is subject to change based on updates to OFAC sanctions programs. Users are responsible for ensuring their compliance with applicable sanctions laws.

9. Content Moderation and DMCA

AI Music Hub respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA):

  • We will remove infringing content upon receiving valid DMCA takedown notices
  • Repeat infringers will have their accounts terminated
  • Counter-notifications may be submitted if you believe content was wrongly removed
  • We reserve the right to remove any content at our discretion

10. Contests and Competitions

For platform-hosted contests:

  • Entry fees and prizes are set by AI Music Hub and clearly displayed
  • Winners are determined by community votes and play counts
  • Prizes are paid via Stripe to the winner's connected account
  • AI Music Hub reserves the right to disqualify entries that violate these terms
  • Free contest entries may be removed from the platform after the contest ends

11. Limitation of Liability

AI Music Hub is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to AI Music Hub in the 12 months preceding any claim.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your right to use the platform ceases immediately. Any pending payouts may be withheld if there are unresolved disputes or violations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration.
